Civil procedure is constantly evolving, and keeping pace with ongoing amendments is crucial for legal practice. That is why, after four years, a completely revised and updated edition of this essential commentary on the Code of Civil Procedure is being published by C. H. Beck. The commentary reflects all legislative changes and case law from the past four years. The book was produced by a team of experienced judges, academics and solicitors who are among the very best in the field of civil procedural law, including JUDr. Vít Hrnčířik, Ph.D., LL.M., a solicitor and managing partner at Equity Legal. For this edition, he comprehensively compiled the section dealing with judgements, orders, payment orders, European payment orders and bill of exchange payment orders (Sections 152 to 175).
The book deals with the issue of the judicial settlement of restitution claims through the transfer of other agricultural land owned by the state. Case law has gradually established, within the domestic legal environment, a wholly unique and distinct body of legal rules designed to ensure that one of the purposes of the Land Act can be fulfilled at all, namely the redress of certain property injustices arising from the violation of generally recognised human rights and freedoms by the state under the former regime. It is precisely the analysis of this judicial case law that forms the bulk of this publication.
This monograph examines the questions of whether the lay element in the judiciary remains a democratising factor; whether, in the case of lay judges, the constitutional requirements for an independent, impartial and lawful judge are sufficiently met; whether democratic or professional legitimacy should take precedence; and, finally, whether the lay element in the Czech judiciary should be retained.
This book presents civil law in a new form, unique within the Czech legal context. The team of authors provides an explanation of the institutions and issues of civil procedure in the context of the most significant court decisions. The casebook is divided into four parts – contentious proceedings, enforcement proceedings, proceedings under the Act on Special Judicial Proceedings, and proceedings in matters decided by another authority. Each chapter is devoted to an explanation of the relevant topic, supplemented by court decisions and a discussion of specific related issues.
This publication examines public-law coordination agreements within the Czech legal system. Its aim is to attempt a systematic classification of these agreements and to evaluate their regulation in terms of both substantive and procedural law. All this is done whilst taking into account both domestic and foreign literature and the case law of the Supreme Administrative Court.
The second edition of this highly successful commentary responds to changes to the Code of Civil Procedure that have taken place since the first edition was published in 2013. The updates concern, for example, the enforcement of judgments through the sale of immovable property, the conditions for the admissibility of appeals, and the regime governing the enforcement of claims against property held in the joint property of spouses and the property of a spouse who is the debtor. The commentary also takes into account developments in case law – for example, landmark decisions of the Constitutional Court, which offer a new interpretation of the essence of the court’s duty to advise a party of the likelihood of failure in a dispute.
Publikace Víta Hrnčiříka nabízí systematický pohled na předběžná opatření podle OSŘ a ZŘS. Je jedinou českou monografií zpracovávající toto živě diskutované a vysoce prakticky relevantní téma. Řada problémů spojených s předběžnými opatřeními je kontroverzní na společenské i právní úrovni. Práce se zabývá základními otázkami práva předběžných opatření, analyzuje je a přichází s řešením jednotlivých aplikačních a praktických problémů. Inspiruje se jak v historii, tak ve srovnatelných právních řádech (zejména Rakouska a Německa). Jde především o příručku pro právní a soudní praxi.
Komentář je praktickým textem zabývajícím se konkrétní aplikací procesních předpisů a postupem soudů. Vít Hrnčiřík je autorem části týkající se rozsudků a usnesení, směnečného platebního rozkazu, platebního rozkazu, evropského a elektronického platebního rozkazu, rozsudku pro uznání a rozsudku pro zmeškání.
